SARAJEVO, October 9 /SRNA/ - Judging at first instance, the Court of Bosnia and Herzegovina sentenced Jozo Djojic, a former member of the 102nd brigade of the Croatian Council of Defence /HVO/ in Odzak, to six years’ imprisonment for raping a Serb woman in Odzak in 1992.
Judge Darko Samardzic said that following an analysis and assessment, the trial panel established beyond reasonable doubt that Djojic had committed the crime he was charged with. He noted that all evidence and statements by ten witnesses had confirmed that Djojic raped the injured woman identified as M.L. According to Samardzic, the rape was committed on an undefined day in July in a flat where the injured party had stayed together with several other women.
Refusing the woman’s plea not to do it, Djojic committed the rape first in the pantry, and then in another room, brutally, threatening to kill her six-month-old son if she resisted him, said the judge, reading the reasoning of the judgement.
The trial panel found the statements by witnesses, including Nada Lesic, who was an eyewitness, consistent and acceptable. Samardzic said the punishment was proportionate to the committed crime. He said the defence had not disputed the veracity of events. The defendant may file a complaint against the judgement within the next 15 days. The Court ordered the extension of restrictive measures to Djojic, especially as there is a danger of prison break now that he has been sentenced. He did not attend the pronouncing of the judgement on Monday due to health reasons, the Court said. |
